5. TERMS OF SALE

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Shipping Policy for further information.

In order to contract with éanè Clothing you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.  éanè Clothing retains the right to refuse any request made by you.

  • 5.A.1 Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until we have conducted any verification (see 5.C.1 below) that may be necessary for your order, your payment has been approved by us and we have debited your credit or debit card.

  • 5.B.1. Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Checkout Cost'.

The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.   • 5.C.1. Verification Process

For security purposes, we may require additional verification or information to enable us to complete your order. We may ask you to supply the following information:

A copy of your photographic driver’s license verifying your identity and billing address.

If the billing address differs from the address specified on your license, proof of address will be required in the form of a bank statement or other relevant documentation.

Other relevant documentation may be requested by our Online Team.

  • 5.D.1. Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed.

Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.

  • 5.D.2. Payment

The conditions of use relating to any discount code will be specified at the time of issue.

  • 5.E.1. Gift Cards

Gift cards may be physical gift cards that are sent in an email. Gift cards are issued in Australian dollars and are redeemable on the Australian website. They are not redeemable for cash or travellers cheques. No change will be given for a purchase made with a gift card. The gift card expires twelve months from the date of issue (or date of purchase for E-Gift Cards). Gift cards are partially redeemable and it is up to the cardholder to use the full value within the validity period. Any unused balance will not be refunded or credited when the card expires. When the cost of a purchase exceeds the available card balance, the cardholder will be required to make up the difference with an alternate form of payment. Gift Cards should be treated like cash. éan Clothing disclaims all responsibility for lost or stolen cards.

6. DISCLAIMER OF LIABILITY

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. RETURNS POLICY

1. OUR CHANGE OF MIND POLICY

We want to give you a hassle-free way to get the correct items so you can enjoy your purchases.

At éanè Clothing, we are happy to offer you an exchange or credit note for change of mind on most full price and reduced merchandise. The following change of mind timeframes apply:

  • Online (Australia): 14 days from date of delivery

  • Online (International): 30 days from order placement

Subject to the Consumer Guarantees outlined below, merchandise returned for change of mind within the above timeframes can be returned for an exchange or credit note subject to the following conditions:

  • Proof of purchase is accompanied with the returned merchandise;

  • The merchandise is unworn, unwashed, unused and in its original condition with all tags intact;

  • Refunds are not given for incorrect size choice or change of mind; please choose carefully;

  • Items purchased in éanè Clothing Website are subject to their respective return policies and procedures.

  • Due to hygiene reasons, all éanè Clothing Website underwear and swimwear are unable to be returned for change of mind.

2. CONSUMER GUARANTEES

We make every effort, from concept to coat hanger, to ensure that every éanè Clothing garment meets our high standards.

Our Change of Mind Policy does not affect your rights under Consumer Law and you have consumer guarantees that cannot be limited by us.  If your product is not of acceptable quality, is not fit for its purpose or is different from its description or sample, then you may be eligible for a refund, exchange or any drop in value of the product (if you choose to keep it).

If you have purchased a product with a major fault, you have the right to ask for your choice of a replacement or refund replacement. If you purchased a product with a minor fault, we can choose to give you a free repair instead of a replacement or refund.

Merchandise returned under consumer guarantees can be returned within a reasonable timeframe subject to proof of purchase.

Please note that all return postage costs for change of mind and exchanges are at your own expense. If you are returning or exchanging a faulty, damaged or incorrectly described item, éanè Clothing will refund all associated return packaging and postage costs.

Goods are your responsibility until they reach us, so make sure it's packaged securely and obtain tracking information when posting.
